Information on data protection

The use of offerings of the Bremen Chamber of Employees ("Arbeitnehmerkammer Bremen") may be connected with the processing of your personal data, provided that you have given us your consent or processing is necessary for the performance of the tasks entrusted to us. 

Data is processed in strict compliance with data protection regulations. We would like to inform you about the processing of your personal data and your related rights.

3. Type of personal data processed, purposes of processing, legal basis of processing, duration of storage

a) When visiting the website

When you visit our website www.arbeitnehmerkammer.de, the browser used on your device automatically sends information to the server of our website. This information is temporarily stored in a so-called log file. 

aa) Types of data processed

The following information is recorded without your intervention and stored until it is automatically deleted:

  • IP address of the requesting computer,
  • date and time of access,
  • name and URL of the downloaded file,
  • website from which access is made (referrer URL),
  • the browser used and, if applicable, the operating system of your computer as well as the name of your access provider.

bb) Purposes of the processing operation

The data listed will be processed by us for the following purposes:

  • ensuring a smooth connection to the website,
  • ensuring convenient use of our website,
  • evaluation of system security and stability, as well as
  • for other administrative purposes.

The legal basis for data processing is Art. 6 para. 1 sentence 1 lit. f GDPR. Our legitimate interest follows from the purposes listed above for data collection. Under no circumstances do we use the data collected for the purpose of drawing conclusions about you personally.

In addition, we use cookies and analysis services when you visit our website. For further explanations, please refer to paras. 4 and 5 of this privacy policy.

b) When registering for our newsletter

Provided that, in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR, you have expressly consented, we will use your e-mail address to send you our newsletter on a regular basis. To receive the newsletter, all you need to do is provide your e-mail address.

You can unsubscribe at any time, for example via a link at the end of each newsletter. Alternatively, you can also send your unsubscribe request by e-mail to service@arbeitnehmerkammer.de.

c) When using our contact form "General questions"

If you have any questions, you may contact us using the form provided on the website. Your name and a valid e-mail address are required so that we know who sent the request and can respond to it. Further information can be provided voluntarily. 

Data processing for the purpose of contacting us is carried out in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR on the basis of your voluntary consent. 

The personal data collected by us for the use of the contact form will automatically be deleted after your request has been processed.

d) When using our contact form "Suggestions, praise and criticism"

You can use this form to contact us with suggestions, praise or criticism. It is necessary to provide your name, a valid e-mail address, your home address and details of your employment relationship to check your membership in the Bremen Chamber of Employees and to process your suggestions, praise or criticism.

Data processing for the purpose of contacting us is carried out in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR on the basis of your voluntarily consent as well as legitimate interest according to Art. 6 para. sentence 1 lit. f GDPR, whereby our legitimate interest lies in the determination of your chamber affiliation in accordance with Section 4 of the law on the Chamber of Employees in the state of Bremen ("Gesetz über die Arbeitnehmerkammer im Land Bremen ").

The personal data collected by us for the use of the contact form will be automatically deleted after the request has been settled.

e) When using the contact form "Legal questions"

Legal questions can be addressed to us via this contact form. It is necessary to provide your name, a valid e-mail address, your home address and details of your employment relationship to check your membership in the Bremen Chamber of Employees and to process your request.

Data processing for the purpose of contacting us is carried out in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR on the basis of your voluntarily consent as well as legitimate interest according to Art. 6 para. sentence 1 lit. f GDPR, whereby our legitimate interest lies in the determination of your chamber affiliation in accordance with Section 4 of the law on the Chamber of Employees in the state of Bremen ("Gesetz über die Arbeitnehmerkammer im Land Bremen ").

Data processing for the purpose of processing your request is carried out in accordance with Art. 6 para.1 sentence 1 lit. b GDPR in conjunction with the advisory mandate given to us.

If it is not possible to answer your question because you are not a member of the Chamber of Employees, the personal data collected by us for the use of the contact form will be automatically deleted after a corresponding notification to you.

When processing your legal question, your data processed for this purpose will be deleted at the end of the legal retention period. This is currently ten years.

f) Tax appointments

If you wish to book a tax appointment via our website, you will need to provide your name and the number of your valid "KammerCard".

Data processing for the purpose of contacting us is carried out in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR on the basis of your voluntarily consent as well as legitimate interest according to Art. 6 para. sentence 1 lit. f GDPR, whereby our legitimate interest lies in the determination of your chamber affiliation in accordance with Section 4 of the law on the Chamber of Employees in the state of Bremen ("Gesetz über die Arbeitnehmerkammer im Land Bremen ").

In a second step, you will receive an overview of your master data that has already been deposited with us. If we do not have this information yet, you will need to provide us with a valid e-mail address and your telephone number. The processing of this data is based on a legitimate interest according to Art. 6 para. sentence 1 lit. f GDPR, whereby our legitimate interest lies in sending the appointment confirmation as well as, if necessary, contacting you in the case of short-term changes to the appointment.

Subject to applicable statutory retention periods, the processed data will be deleted immediately if it is no longer necessary for the purpose for which it is processed.

g) When registering for events

If you register for an event on our website, you must provide your name, a valid e-mail address, your telephone number and, if necessary, your name. Information about your employer and your function is required. The data will be processed for the purpose of processing your registration and holding the event. This includes, for example, the creation of a list of participants, the dispatch of event-relevant materials (e.g. confirmation of participation, event documentation) and contact to provide information about date changes and cancellations. Your data will also be processed in order to be able to hold an event oriented to the interests of the participants.

Data processing for the purpose of contacting us is carried out in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR on the basis of your voluntarily consent as well as legitimate interest according to Art. 6 para. sentence 1 lit. f GDPR, whereby our legitimate interest lies in the continuous improvement of our event offering. 

4. Recipients of data

The processing of your personal data takes place in each case by the employees of the Bremen Chamber of Employees who are responsible for processing your request.

Your personal data will not be transferred to third parties for purposes other than those listed below.

We will only disclose your personal data to third parties if:

  • you have expressly consented to this under Art. 6 para. 1 sentence 1 lit. a GDPR,
  • disclosure is necessary in accordance with Art. 6 para. 1 sentence 1 lit. f GDPR to assert, exercise or defend legal claims and there is no reason to believe that you have an overriding interest in not disclosing your data,
  • in the event that disclosure in accordance with Art. 6 para. 1 sentence 1 lit. c GDPR is a statutory obligation, provided
  • this is legally permissible and in accordance with Art. 6 para. 1 sentence 1 lit. b GDPR it is required for the processing of contractual relationships with you.

The Chamber of Employees commissions external service providers (e.g. with the postal dispatch of documents or the maintenance of our software). These service providers work for the Chamber of Employees within the framework of a processing order (Article 28 GDPR) and process personal data exclusively in accordance with the instructions issued to them by the Chamber of Employees and are not authorized to process the data for purposes other than those described here.

5. Cookies

We use cookies on our website. These are small files that your browser automatically creates and that are stored on your device (laptop, tablet, smartphone, etc.) when you visit our website. Cookies do no damage to your device, do not contain viruses, Trojans or other malware.

Information is stored in the cookie that results in each case in connection with the specifically used terminal device. However, this does not mean that we immediately become aware of your identity.

The use of cookies serves on the one hand to make the use of our offer more pleasant for you. For example, we use so-called session cookies to recognize that you have already visited individual pages of our website. These will be deleted automatically after leaving our site.

In addition, we also use temporary cookies that are stored on your terminal device for a specifically determined period of time for optimization of user-friendliness. If you visit our site again to use our services, it will automatically recognize that you have already been with us and what entries and settings you have made so that you do not have to enter them again.

On the other hand, we use cookies to statistically record the use of our website and to evaluate it for the purpose of optimizing our offer for you (see Section 5). When you return to our site, these cookies enable us to recognize automatically that you have already been with us. These cookies are automatically deleted after a defined period of time.

The data processed by cookies is required for the purposes mentioned for the protection of our legitimate interests as well as of third parties according to Art. 6 para. 1 sentence 1 lit. f GDPR.

Most internet browsers accept cookies automatically. However, you can configure your browser so that no cookies are stored on your computer, or a message always appears before a new cookie is created. Complete deactivation of cookies, however, may result in you being unable to use all the functions of our website.

6. Use of YouTube

We partly integrate the videos found on our website with the help of the provider YouTube. The embedding takes place in the extended data protection mode. For more information about privacy on YouTube, please see the provider's privacy policy.

7. Analysis tools

The tracking measures listed below and used by us are based on Art. 6 para. 1 sentence 1 lit. f GDPR. With the tracking measures used, on the one hand, we want to ensure that our website is designed to meet requirements and is continually optimized. On the other hand, we use the tracking measures to statistically record the use of our website and to evaluate it for the purpose of optimizing our offer. These interests are to be regarded as legitimate under the aforementioned provision.

Matomo

We use the open source software Matomo to analyze and statistically evaluate the use of the website. Cookies are used for this purpose (see Section 4). The information generated by the cookie about website usage is transmitted to our servers and combined in pseudonymous user profiles. The information is used to evaluate the use of the website and to enable a demand-oriented design of our website. This data will not be transferred to third parties.

Under no circumstances will the IP address be linked to other data relating to the user. The IP addresses are anonymized, such that an assignment is not possible (IP masking).

6. Social media plug-ins

On our website, on the basis of Art. 6 para. 1 sentence 1 lit. f GDPR, we set social plug-ins of the social networks Facebook, Twitter and Google+ to make the Bremen Chamber of Employees better known. The underlying advertising purpose is to be regarded as a legitimate interest under the GDPR. Responsibility for data protection-compliant operation must be guaranteed by the respective provider. The integration of these plug-ins by us is done using the so-called Shariff to protect visitors of our website in the best possible way.

a) Facebook

Our website uses social media plug-ins from Facebook to personalize their use. For this we use the "LIKE" or "SHARE" button. This is an offer from Facebook.
If you access a page of our website that contains a social plug-in, your browser establishes a direct connection with the Facebook servers. The content of the plug-in is transferred from Facebook directly to your browser, which then embeds it into the website.
Through the integrated plug-in, Facebook receives the information that your browser has accessed the corresponding page of our website, even if you do not have a Facebook account or are not currently logged in to Facebook. This information (including your IP address) is transmitted from your browser directly to a Facebook server in the USA and stored there.
If you are logged into Facebook, Facebook can link the visit to your Facebook account. If you interact with the plug-ins, for example by pressing the "LIKE" or "SHARE" button, that information is also transmitted directly to a Facebook server and stored there. The information is also published on Facebook and displayed to your Facebook friends.
Facebook can use this information for the purposes of advertising, market research and tailored design of Facebook pages. For this purpose, Facebook creates use, interest and relationship profiles, e.g. in order to evaluate your use of our website in terms of the advertisements displayed for you on Facebook, to inform other Facebook users about your activities on our website and to provide other services relating to the use of Facebook.
If you do not want Facebook to link the data collected on our website to your Facebook account, you must log out from Facebook before visiting our website.

b) Twitter

Our website contains integrated plug-ins from the short message network, Twitter Inc. (Twitter). You can recognize the Twitter plug-ins (tweet button) by the Twitter logo on our site. An overview of the tweet buttons can be found here (https://about.twitter.com/resources/buttons).
When you access a page of our website that contains such a plug-in, a direct connection is established between your browser and the Twitter server. This enables Twitter to receive information that you have visited our site with your IP address. If you click the Twitter "tweet button" while logged into your Twitter account, you can link the contents of our pages on your Twitter profile. This allows Twitter to associate your visit of our pages with your user account. Please note that, as the provider of this site, we have no knowledge of the content of the data that is transmitted to Twitter or of how Twitter uses this data.

a. Right of information

You have the right to request information at any time as to whether and which personal data concerning you is processed by us. (Art. 15 GDPR)

b) Right to rectification

You have the right to request the correction of your personal data without undue delay. (Art. 16 GDPR)

c) Right to deletion

You have the right to ask us to delete your personal data without delay. This applies in particular if the personal data is no longer necessary for the purposes for which it was collected or otherwise processed, if you have revoked an informed consent form or if the processing is unlawful. (Art. 17 GDPR)

d) Right to limitation of processing

You have the right to request that we limit processing (blocking) if one of the following conditions is met:

  1. the accuracy of the personal data is contested by the data subject, for a period enabling the data controller to verify the accuracy of the personal data,
  2. the processing is unlawful, and you reject the deletion of the personal data and instead demand the restriction of the use of personal data,
  3. we no longer need your personal information for processing purposes, but you do need the information to assert, exercise or defend your rights. 

If processing has been restricted, such personal data – apart from being stored – may be processed only with your consent or for the purpose of asserting, exercising or defending rights or protecting the rights of another natural or legal person or on the grounds of an important public interest. (Art. 18 GDPR)

e. Right to object to processing

You have the right to object to the processing of your personal data, provided the legal requirements are met. (Art. 21 GDPR)

f. Right to revocation

If the processing of your personal data is based on consent pursuant to Art. 6 para.1 sentence 1 lit. a GDPR, you can revoke this consent at any time with effect for the future.

g. Right to data portability

9. Data security

We use the most common SSL (Secure Socket Layer) method together with the highest level of encryption supported by your browser. Usually, this is 256-bit encryption. Whether a single page of our website is transmitted in encrypted form, is indicated by the closed representation of the key or the lock icon in the status bar of your browser.
We also use suitable technical and organizational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction, or unauthorized access by third parties. Our security measures are continuously improved corresponding to the technological developments.

10. Updating and changing this data protection information

This data protection information is currently valid as of May 2018.
It may be necessary to change this data protection information as a result of further development of our website and services, or due to changes in statutory or regulatory requirements.
